For more than a half-century, evidence scholars have been exploring whether the criminal standard of proof can be grounded in decision theory. Such grounding would require the emergence of a social consensus about the utilities to be assigned to the four outcomes at trial. Significant disagreement remains, even among legal scholars, about the relative desirability of those outcomes and even about the formalisms for manipulating their respective utilities. We attempt to diagnose the principal reasons for this dissensus and to suggest (...) ways in which a broadly shared evaluation might be forged, both with respect to the appropriate equations for defining the standard of proof and with respect to the appropriate utilities to associate with the various trial outcomes. Where consensus cannot be forged, we hold that remaining differences can probably be finessed. We also suggest ways to elicit the utilities of individuals on these matters so as to avoid the usual flaws of such surveys. Along the way, we note a). the disproportionate role that the Blackstone ratio of errors continues to play in appraisals of the utilities of trial outcomes (despite its unintelligibility in the context of utilities) and b). the persisting belief -for which there is no theoretical basis-that every plausible assignment of utilities will inevitably result in a very high standard of proof. This discussion adjudicates a dispute between Larry Laudan and Gerald Doppelt over the nature of methodological rules. Laudan holds that all methodological rules are hypothetical imperatives, while Doppelt argues that a subset of those rules, basic methodological standards, are not hypothetical imperatives. I argue that neither writer offers a satisfactory account of methodological rules and that their reliance on the hypothetical/nonhypothetical distinction does not advance our understanding of methodological rules. In lieu of an abstract, here is a brief excerpt of the content:BOOK REVIEWS 475 whereas in some texts Aquinas explicitly teaches that the higher senses of vision and hearing are the ones that mainly (praecipue, principaliter) lead to aesthetic experience.t5 Moreover, the statement that only in the thirteenth century was the question of the distinction between the higher and lower senses explicitly raised (p. l13f.), is true only if the author meant to exclude the pre-medieval or patristic as well (...) as the ancient period of philosophy.16 Finally, there is one technical weakness in this book that cannot be left unmentioned. The overwhelming majority of references are not to the original medieval texts treated and/or quoted in the three-volume edition, but to the number of volume and page in that edition. Thus the reader must be both familiar with French and in possession of the original three-volume work, or remain hopelessly frustrated every time he wishes to consult the original texts or at least know which texts are being mentioned. Yet, if one knows French, he does not need the English translation; and if he is also fortunate enough to have access to the original three-volume version, he will not need the abridged version of the original work at all. For this reason, should there be a second edition of this translation, the references should be changed from the l~tudes to the original medieval works. Although the negative remarks are more lengthy in this review than the positive evaluation is, it would be a grave mistake to conclude from this that the defects outweigh the value of the book. As a matter of fact, upon finishing the reading of this translation of De Bruyne's work, this reviewer was left with the conviction that, in the final balance, the reader can only greatly benefit from this work, and we all owe gratitude to the translator for having made this highly informative work available in the English language. Risse, and C. Vasoli have pointed out the vitality and significance associated with the development of the logical thought of the period. The general question of methodology has produced an enormous scholarly literature in recent years,I but much remains to be done before we fully understand how various methodologies have evolved and what relation philosophical discussions of method have had to the actual practice of science. Unfortunately, Crescini's book is on the whole disappointing, although nearly everyone will find the odd bit of information of which he was not previously aware. It definitely does not, however, establish a solid foundation for later studies. The book is organized into three principal parts, dealing with the development of the analytic method in logic (pp. 21-188), in the natural sciences (pp. 189-284), and in mathematics (vv. 285-328). Like most philosophers, Laudan [7] believes that by and large science makes cognitive progress and that the development of science is more or less rational. His book deals with two major problems:(a)In what sense does science progress? What is scientific progress?(b)Wherein lies the rationality of the growth of science? What is scientific rationality?In the main body of this paper, I first summarize and evaluate some of Laudan’s criticisms of his predecessors. We examined the links between moral identity—the centrality of moral principles to identity—and political purpose during emerging adulthood. We analyzed data from two waves of a longitudinal study of civic purpose. T1 surveys were collected before high school graduation and T2 survey were collected two years later. We categorized people (N = 1,578 at T1 and N = 480 at T2) into political purpose groups based on the person-centered perspective and then performed multinomial logistic regression analysis to test whether moral (...) identity was associated with categories of political purpose. Laudan constructs a fresh approach to a longtime problem for the philosopher of science: how to explain the simultaneous and widespread presence of both agreement and disagreement in science. Laudan critiques the logical empiricists and the post-positivists as he stresses the need for centrality and values and the interdependence of values, methods, and facts as prerequisites to solving the problems of consensus and dissent in science.

This essay contains a partial exploration of some key concepts associated with the epistemology of realist philosophies of science. It shows that neither reference nor approximate truth will do the explanatory jobs that realists expect of them. Equally, several widely-held realist theses about the nature of inter-theoretic relations and scientific progress are scrutinized and found wanting. Finally, it is argued that the history of science, far from confirming scientific realism, decisively confutes several extant versions of avowedly 'naturalistic' forms of scientific (...) realism. The purpose of this study was to test whether personal commitment to community was related to political involvement in two cultural contexts: Italy and the USA. Participants were 566 adolescents aged 14–19 years : 311 Italians and 255 Americans. Participants filled out a self-report questionnaire. Analyses of variance revealed that American high school students reported higher levels of personal commitment to community than did their Italian peers and that many forms of political involvement were significantly more common among American adolescents. (...) Structural equation modeling analyses revealed that personal commitment to community was strongly and positively associated with involvement in political activities in both adolescent samples. Thus, fostering personal commitments to community could potentially lead youth to political engagement. (shrink)

This book consists of a collection of essays written between 1965 and 1981. Some have been published elsewhere; others appear here for the first time. Although dealing with different figures and different periods, they have a common theme: all are concerned with examining how the method of hy pothesis came to be the ruling orthodoxy in the philosophy of science and the quasi-official methodology of the scientific community. It might have been otherwise. Barely three centuries ago, hypothetico deduction was in (...) both disfavor and disarray. Numerous rival methods for scientific inquiry - including eliminative and enumerative induction, analogy and derivation from first principles - were widely touted. The method of hypothesis, known since antiquity, found few proponents between 1700 and 1850. During the last century, of course, that ordering has been inverted and - despite an almost universal acknowledgement of its weaknesses - the method of hypothesis (usually under such descriptions as 'hypothetico deduction' or 'conjectures and refutations') has become the orthodoxy of the 20th century. Behind the waxing and waning of the method of hypothesis, embedded within the vicissitudes of its fortunes, there is a fascinating story to be told. Normative naturalism is a view about the status of epistemology and philosophy of science; it is a meta-epistemology. It maintains that epistemology can both discharge its traditional normative role and nonetheless claim a sensitivity to empirical evidence. The first sections of this essay set out the central tenets of normative naturalism, both in its epistemic and its axiological dimensions; later sections respond to criticisms of that species of naturalism from Gerald Doppelt, Jarrett Leplin and Alex Rosenberg.

It has also been assumed that it is impossible to make objective, Comparative judgements of the acceptability of rival theories unless all the statements of both theories could be translated into a common language. Most contributions to Whewell scholarship have tended to stress the idealistic, antiempirical temper of Whewell’s philosophy. Thus, the only two monograph-length studies on Whewell, Blanché’s Le Rationalisme de Whewell and Marcucci’s L’ ‘Idealismo’ Scientifico di William Whewell, are, as their titles suggest, concerned primarily with Whewell’s departures from classical British empiricism. Particularly in his famous dispute with Mill, it has proved tempting to parody Whewell’s position in the debate by treating it as a straightforward encounter between an arch-empiricist and an (...) arch-rationalist. There is, however, a danger that an emphasis on the necessitarian and a priori elements in Whewell’s philosophy may well obscure the unmistakable empirical emphasis in Whewell’s theory of science. I think it is time to begin to redress the balance, by focusing attention on the significant ‘empiricist’ strains in Whewell’s philosophy of science. One of the most important of those strains is connected with the operation which Whewell calls ‘the consilience of inductions’. (shrink)
